The lawyer Wolfgang Wessely, Chairman of the Senate at the Provincial Administrative Court and lecturer at the University of Vienna, published a legal opinion on Section 19 of the Animal Welfare Act. In it, he clarifies that animal owners must protect their animals even if an alpine pasture is considered “unprotectable”. There are no blanket exceptions; each individual case must be examined. It also emphasizes the duty of the district authorities to intervene in the event of violations – for example by imposing conditions, ordering night penning or, in extreme cases, by removing the animals.
